Terms of Service

Pitchsafe provides regulatory information and decision support, not legal advice. Nothing produced by the platform is a substitute for advice from a qualified solicitor or attorney. You must independently verify every output before relying on it.

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Pitchsafe website, application, APIs, and related services (collectively, the "Service"), operated by Pitchsafe Ltd ("Pitchsafe", "we", "us"). By creating an account, accessing, or using the Service you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" includes that organisation.

2. The Service — informational only

The Service surfaces, summarises, and synthesises regulatory and advertising-standards information relevant to influencer and brand marketing. All outputs — including pitch-check reports, obligations, citations, paralegal answers, case studies, and corpus passages — are provided for general informational and decision-support purposes only. They are not legal advice, not a legal opinion, and not a substitute for professional judgment. We do not act as your lawyer and no solicitor–client or attorney–client relationship is created. You are solely responsible for any decision you make and must obtain independent professional advice before acting.

3. No warranty; accuracy

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currency, or non-infringement. Regulation changes constantly and across jurisdictions; we do not warrant that any output is accurate, complete, current, or applicable to your circumstances. To the maximum extent permitted by law, we disclaim all such warranties.

4. Your responsibilities and acceptable use

  • You must provide accurate account information and keep your credentials secure.
  • You must independently verify all outputs and comply with all laws applicable to your campaigns.
  • You must not misuse the Service, including: reverse-engineering, scraping, reselling or sublicensing outputs, attempting to access other customers' data, circumventing limits, uploading unlawful content, or using the Service to build a competing product.
  • You are responsible for all activity under your account and for any content you submit.

5. Intellectual property

The Service, including its software, design, knowledge base, document corpus, taxonomy, prompts, and all generated report templates and formats, is owned by Pitchsafe Ltd or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your internal business purposes during your subscription. Subject to your retained rights in content you upload, you assign to us, and we own, all rights in the Service and in any improvements, feedback, or aggregated/anonymised data derived from your use.

6. Limitation of liability

To the maximum extent permitted by law, Pitchsafe Ltd, its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business, arising out of or related to your use of (or inability to use) the Service, regulatory enforcement, fines, or campaign outcomes — even if advised of the possibility. Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the fees you paid to us in the twelve (12) months before the event giving rise to the claim, or (b) £100. Nothing in these Terms excludes liability that cannot be excluded under applicable law (such as for death or personal injury caused by negligence, or fraud).

7. Indemnification

You will indemnify, defend, and hold harmless Pitchsafe Ltd and its personnel against all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your campaigns, your reliance on any output, or your breach of these Terms or applicable law.

8. Subscriptions and changes

Paid plans, limits, and billing terms are described at checkout and may change. We may add, modify, suspend, or discontinue any part of the Service, and may change these Terms, at our discretion; material changes will be posted here with an updated date and, where required, notified to you. Continued use after changes constitutes acceptance.

9. Suspension and termination

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have breached these Terms, created risk or legal exposure for us, or for any other reason at our discretion. You may stop using the Service at any time. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, and indemnification) survive.

10. Governing law

These Terms are governed by the laws of England and Wales, and you and we submit to the exclusive jurisdiction of the courts of England and Wales. If any provision is held unenforceable, the remainder continues in effect. These Terms are the entire agreement between you and us regarding the Service and supersede prior understandings.
